ACCEPTANCE OF TERMS

By using Kids N Culture’s (“KNC”) kidsnculture.org website (“Site”) and service (“Service”), you signify that you have read, understand and agree to be bound by the following Privacy Policy (“Privacy Policy”). If you do not agree to be bound by this Privacy Policy, you are not permitted to use or access the Site or Service in any way.

INFORMATION

You agree that this Privacy Policy and your use of this Site or otherwise is governed by KNC’s Terms of Use (currently available at “Terms of Use”).

COLLECTION OF AND USE OF INFORMATION

When KNC uses the term “Personally Identifiable Information” in this Privacy Policy, KNC means any information that can be used to identify a specific individual, such as a name, address, telephone number or email address. When KNC uses the term “Non-Personally Identifiable Information” in this Privacy Policy, KNC means information that does not allow KNC to identify a specific individual, such as demographic information, areas visited on the Site or what type of computer or mobile device was used to access the Site.

KNC only collects Personally Identifiable Information about individuals when such information is specifically provided by such individuals (a “User”) through their use of the Site. For example, when you contact the Site or donate to KNC, you may be asked to provide personal information such as your name, mailing address, e-mail address, date of birth, gender, phone number or billing/credit card information. Without limiting the generality of the foregoing, KNC may use your Personally Identifiable Information for the following purposes:

  1. to use it for the purposes for which it was provided to KNC by you;

  2. to contact you with information which KNC believes that you may find beneficial or interesting;

  3. to send you promotions or newsletters;

  4. to administer sweepstakes and contests;

  5. to process and respond to your inquiries;

  6. to enhance and/or develop the display of customized content and advertising on the Site;

  7. to effectively administer and operate the Site;

  8. to operate, evaluate and improve KNC’s business (including developing new products and services; managing KNC’s communications; analyzing KNC’s services; performing data analytics; and performing accounting, auditing and other internal functions);

  9. to comply with any and all laws applicable to KNC;

  10. to respond to governmental inquiries or requests made upon KNC;

  11. to comply with valid legal process imposed upon KNC;

  12. to protect the rights, privacy, safety or property of the Site and the general public;

  13. to permit KNC to pursue available remedies or limit the damages that KNC may sustain;

  14. to enforce the Terms of Use; and

  15. as set forth below.

DISCLOSURE OF INFORMATION

From time to time, KNC may make certain portions of your Personally Identifiable Information (such as names and email addresses) available to reputable companies whose products or services KNC feels may interest you. KNC may also disclose your Personally Identifiable Information to other affiliates, strategic partners or to KNC’s third party service providers that agree to treat it in accordance with this Privacy Policy.

You may always opt-out of receiving marketing communications from KNC. To remove any Personally Identifiable Information from KNC’s database or to elect not to receive future e-mail communications, send an e-mail to info@kidsnculture.org with the word “remove” in the subject line.

SECURITY OF INFORMATION

The importance of security for all Personally Identifiable Information associated with KNC’s Users is of utmost concern to KNC. While KNC strives to protect your Personally Identifiable Information and make you feel as comfortable as possible when using the Site, you acknowledge that: (1) there are security and privacy limitations of the internet which are beyond KNC’s control; (2) the security, integrity and privacy of any and all information and data exchanged between you and KNC through the Site cannot be guaranteed; and (3) any such information and data may be viewed or tampered with in transit by a third party. KNC may post a notice on the Site if a security breach occurs.

PASSIVE AND NON-PERSONALLY IDENTIFIABLE INFORMATION COLLECTION

As you navigate through any website, certain information can be passively collected (that is, gathered without your actively providing the information) using various technologies and means, such as Internet protocol (“IP”) addresses, cookies, Internet tags, and navigational data collection.

The Site may use IP addresses. An IP address is a number assigned to your computer by your Internet service provider so you can access the Internet and is generally considered to be Non‑Personally Identifiable Information because in most cases an IP address is dynamic (i.e., changing each time you connect to the Internet), rather than static (i.e., unique to a particular User’s computer). KNC may use your IP address to diagnose problems with KNC’s server, report aggregate information, determine the fastest route for your computer to use in connecting to the Site and administer and improve services to KNC’s consumers.

A cookie is a bit of information that a website sends to your browser that helps a website remember information about you and your preferences. The Site may use cookies.

Session cookies are temporary bits of information that are erased once you exit your browser window or otherwise turn your computer off. Session cookies are used to improve navigation on websites and to collect aggregate statistical information. The Site may use session cookies.

Persistent cookies are more permanent bits of information that are placed on the hard drive of your computer and stay there unless you delete the cookie. Persistent cookies store information on your computer for a number of purposes, such as retrieving certain information you have previously provided (e.g., username) and helping to determine what areas of website visitors find most valuable and customizing the website based on your preferences. The Site may use persistent cookies.

Internet tags (also known as single-pixel GIFs, clear GIFs, invisible GIFs, and 1-by-1 GIFs) are smaller than cookies and tell the website server information such as the IP address and browser type related to the visitor’s computer. The Site may use Internet tags.

Navigational data (log files, server logs, and clickstream data) and internet tags are used for system management, to improve the content of a website, market research purposes and to communicate information to visitors. The Site may use navigational data.

KNC may also use other automated technologies to collect and analyze certain types of information KNC considers to be Non-Personally Identifiable Information including, but not limited to: (1) information related to the computers and/or mobile devices you use to access or interact with the Site (such information including, but not limited to, IP addresses, geolocation information, unique device identifiers and other information about your computers or mobile devices, browser types and browser language); and (2) information related to the ways in which you interact with the Site (such information including, but not limited to, referring and exit pages and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time you viewed the Site and other similar information). KNC may also capture other data, such as search criteria and results.

Please be advised that since Non-Personally Identifiable Information collected in connection with your use of the Site does not personally identify you, KNC may use the Non-Personally Identifiable Information for any purpose whatsoever, and KNC may share such Non-Personally Identifiable Information with third parties for any purpose whatsoever and without limitation.

MODIFICATION OF TERMS

KNC reserves the right, at its sole discretion, to change, modify, add, or delete portions of this Privacy Policy at any time without further notice. Changes to this Privacy Policy will be posted on this page and will indicate at the top of this page the date these terms were last revised.

Continued use of the Site after any such changes constitutes your acceptance of the new Privacy Policy. If you do not agree to abide by these or any future Privacy Policy, do not use or access (or continue to use or access) the Site. It is your responsibility to regularly check the Site to determine if there have been changes to this Privacy Policy and to review such changes.
